Criptext, Inc. (“Company”) values your privacy. The Company develops secure messaging and secure email web and mobile applications. Our products offer, among other things, our users a more secure way of sending text messages and emails by giving them greater control of their information, which helps avoid information leakage and allow them to conduct business more securely. In this Privacy Policy (“Policy”), we describe how we collect, use, and disclose information that we obtain about users of our mobile applications and online products and services (collectively, the “Services”) or when you otherwise interact with us.

By using or downloading any of our software products (each, an “Application”), or using any of our Services, you agree that your personal information will be handled as described in this Policy. Your use of our Services, and any dispute over privacy, is subject to this Policy and our Terms of Service, including its applicable limitations on damages and the resolution of disputes. The Terms of Service are incorporated by reference into this Policy.

What Information Do We Collect About You and Why?

We may collect information about you directly from you and from third parties, as well as automatically through your use of our Services.

Information We Collect Directly From You. Certain areas and features of our Services may require registration. To register you must provide your name, last name, e-mail and password. We also may collect additional optional information from you, including phone number, however, you are not required to provide us with this information. We also collect other information that you provide to us. In addition to information that we collect when you register, we collect information when you use the Services, request customer support and communicate with us. This includes information that you choose to provide.

When you send or receive a text message or email through the use of our products or services, we also collect, process and store the contents of the message (such as photos, audios, videos and/or captions) on our servers. The contents of the text message or email are also temporarily stored on the devices of recipients as well as our servers. All communication data that is stored, whether temporarily or perpetually, is encrypted. Optionally, clients may choose to store sent emails and messages in their own servers.

For private text messages, once the recipient has viewed a message, it is deleted from our servers and our Application is programmed to delete the message from the recipients’ devices. Emails are also deleted from the recipient’s email inbox once the expiration timer set by the sender has been triggered or sooner should the sender recall it. Emails will remain stored on the Company’s servers and/or in Client’s servers.

We do not guarantee that deletion always occurs within a particular timeframe. Also, while the Services are designed to prevent recipients from taking screenshots using our patent-pending screenshot-proof methodology, we do not guarantee or promise that others will never be able to make copies of your message or email. For example, a recipient may be able to take a screenshot in the event of a technical malfunction. In addition, there may be ways to access messages that remain in temporary storage on recipients’ device, computer or email program or even after they are deleted and ways for messages to be intercepted, tracked or copied. You should not use the Services to send messages if you need 100% certainty that the recipient cannot keep a copy or that the message cannot be later retrieved.

Information We Collect Automatically. We may automatically collect the following information about your use of our Services through cookies, web beacons, and other technologies: your domain name; your browser type and operating system; web pages you view; links you click; your IP address; the length of time you visit our or use our Services; and the referring URL, the webpage that led you to us; and information about your message, including the time, date, sender, recipient and recipient email address or text number, and the number of messages that you send and receive and with whom you most frequently exchanging messages. We also may collect the following information about your use of an Application: mobile device ID; location and language information; device name and model; operating system type, name, and version; email client information; your activities within the Application; and the length of time that you are logged into our Application. We may combine this information with other information that we have collected about you or the recipient, including, where applicable, your or the recipient’s user name, name, and other personal information. Please see the section “What About Cookies and Other Tracking Mechanisms?” below for more information about our use of cookies and other tracking mechanisms.

How We Use Your Information

We use the information that we gather about you for the following purposes:

  • To provide our Services to you, to communicate with you about your use of our Services, to respond to your inquiries, to fulfill your orders, process transactions and send you information, and for other customer service purposes.
  • Send you technical notices, updates, security alerts and support and administrative messages.
  • To tailor the content and information that we may send or display to you, to offer location customization, and personalized help and instructions, and to otherwise personalize your experiences while using the our Services. This includes monitoring and analyzing trends, usage and activities in connection with our Services.
  • For marketing and promotional purposes. For example, we may use your information, such as your email address, to send you news and newsletters, special offers, and promotions, or to otherwise contact you about products or information we think may interest you. We also may use the information that we learn about you to assist us in advertising our Services, including on third party applications and websites.
  • To better understand how users access and use our Services, both on an aggregated and individualized basis, in order to improve our Services and respond to user desires and preferences, and for other research and analytical purposes.
  • To administer our customer loyalty program.
  • Email is used for password recovery purposes as well as for login into the Service. Phone numbers are used for customer service purposes in order to provide better support. Also, phone numbers are used for the user to recognize phonebook contacts who are using the Services.
  • Detect, investigate and/or prevent fraudulent, unauthorized or illegal activity.
  • Carry out any other purpose for which the information was collected.

How We Share Your Information

We may share the information that we collect about you, including personally identifiable information, as follows:

  • Users. Your email, which serves as your unique identifier, and any information that you provide using the Services, including, without limitation, messages, content, videos, pictures, comments, and text will be available to, and searchable by, other users and non-users of the Services to whom they are sent. Other users may also look up your email or profile to find you.
  • Affiliates. We may disclose the information we collect from you to our affiliates or subsidiaries; however, if we do so, their use and disclosure of your personally identifiable information will be subject to this Policy.
  • Service Providers. We may disclose the information we collect from you to third party vendors, service providers, contractors or agents who perform functions on our behalf.
  • Business Transfers. If we are acquired by or merged with another company, if substantially all of our assets are transferred to another company, or as part of a bankruptcy proceeding, we may transfer the information we have collected from you to the other company.
  • In Response to Legal Process. We also may disclose the information we collect from you in order to comply with the law, a judicial proceeding, court order, or other legal process, such as in response to a court order or a subpoena.
  • To Protect Us and Others. We also may disclose the information we collect from you where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, violations of our Terms of Use or this Policy, or as evidence in litigation in which Company is involved.
  • Aggregate and De-Identified Information. We may share aggregate or de-identified information about users with third parties for marketing, advertising, research or similar purposes.

Our Use of Cookies and Other Tracking Mechanisms

We use cookies and other tracking mechanisms to track information about your use of our Services. We may combine this information with other personal information we collect from you. Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser for record-keeping purposes. Some cookies allow us to make it easier for you to navigate our Services, while others are used to enable a faster log-in process or to allow us to track your activities at our Service. There are two types of cookies: session and persistent cookies.

  • Session Cookies. Session cookies exist only during an online session. They disappear from your computer when you close your browser or turn off your computer. We use session cookies to allow our systems to uniquely identify you during a session or while you are logged in. This allows us to process your online transactions and requests and verify your identity after you have logged in.
  • Persistent Cookies. Persistent cookies remain on your computer after you have closed your browser or turned off your computer. We use persistent cookies to track aggregate and statistical information about user activity.

Disabling Cookies. Most web browsers automatically accept cookies, but if you prefer, you can edit your browser options to block them in the future. The Help portion of the toolbar on most browsers will tell you how to prevent your computer from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. For users who disable cookies, some features may not function.

California Do Not Track Statement

Criptext does not track its customers over time and across third party websites to provide targeted advertising and therefore does not respond to Do Not Track (DNT) signals. However, some third party sites do keep track of your browsing activities when they serve you content, which enables them to tailor what they present to you. If you are visiting such sites, some browsers allows you to set the DNT signal on your browser so that third parties (particularly advertisers) know you do not want to be tracked.

Third parties that have content embedded on our websites such as a social feature or a stock ticker may set cookies on a user’s browser and/or obtain information about the fact that a web browser visited a specific Criptext website from a certain IP address. Third parties cannot collect any other personally identifiable information from our websites unless you provide it to them directly.

Third Party Analytics and Tracking. We use automated devices and applications, such as Google Analytics, to evaluate usage of our Services and the Application. We also may use other analytic means to evaluate our Services. We use these tools to help us improve our Services, performance and user experiences. These entities may use cookies and other tracking technologies to perform their services. We do not share your personal information with these third parties.

User Generated Content

As part of the Service, you will provide and transmit content and information, including your messages, text, comments, pictures, and any other information. If you provide and transmit content, the content and information may be tracked, intercepted, copied or even become public and Company cannot prevent such information from being used in a manner that may violate this Policy, the law, or your personal privacy.

Third-Party Links

Our Services may contain links to third-party websites. Any access to and use of such linked websites is not governed by this Policy, but instead is governed by the privacy policies of those third party websites. We are not responsible for the information practices of such third party websites.

Security of My Personal Information

We have implemented precautions to protect the information we collect from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. Please be aware that despite our efforts, no data security measures can guarantee 100% security.

You should take steps to protect against unauthorized access to your password, phone, and computer by, among other things, signing off after using a shared computer, choosing a robust password that nobody else knows or can easily guess, and keeping your log-in and password private. We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity.

Access To My Personal Information

You may modify personal information that you have submitted by logging into your account and updating your profile information. Please note that copies of information that you have updated, modified or deleted may remain viewable in cached and archived pages of the Application for a period of time.

Device Information and Settings

Certain features of the Services may require access to your device’s phonebook and image storage applications (e.g., to find friends or to store a message). If you choose to find contacts, the phone numbers in your device's native phonebook will be transmitted. Although you may decide whether or not to use these features, on Android devices you grant permission to access these features as part of the installation process. If you later decide to revoke this permission, you can do so by following the standard uninstall process and removing the Application from your device. For iOS devices, you can grant or revoke your consent at any time and prevent any of the Services from continuing to access your phonebook and image storage applications by changing the settings on your device.

What Choices Do I Have Regarding Use of My Personal Information?

We may send periodic promotional or informational emails to you. You may opt-out of such communications by following the opt-out instructions contained in the e-mail. Please note that it may take up to 10 business days for us to process opt-out requests. If you opt-out of receiving emails about recommendations or other information we think may interest you, we may still send you e-mails about your account or any Services you have requested or received from us.

Children Under 13

Our Services are not designed for children under 13. If we discover that a child under 13 has provided us with personal information, we will delete such information from our systems.
